From 1944 until about 1962 Polish authorities have issued a series of acts, decrees and regulations on the basis of which private owners were deprived of their property. Those nationalization acts were about:

 

  • Warsaw’s land property seized by the decree on ownership and use of land within the area of the capital city of Warsaw. This overtaking was explained by the needs for fast and efficient reconstruction of city Warsaw lying in the rubble.

  • Industry takeovers were based on decrees and acts about: estates abandoned, estates owned by Germans, compulsory state administration, regulating the legal status of property remaining in government’s possession, nationalization of all essential branches of the national economy. On that basis, most of industrial plants, factories, banks, and other businesses were nationalized.

  • Real estate property seized under decrees on agricultural reform. Pursuant on that legislation all large country estates with its movable property and farming industry were overtaken by the State. This takeover was justified by the needs to improve usefulness of land for the public good.

 

 

 

Due to the illegality of the above-mentioned nationalization acts there is the possibility for the former owners or their successors to take legal action. In accordance with the Code of Administrative Procedure unlawful administrative decision can be repealed or deemed to be delivered in a manner inconsistent with the law. In each of these cases the owner or his heirs have the opportunity to get claimed property returned or obtain appropriate compensation.

Our office is engaged in proceeding such cases, resulting in restituting property lost as a result of expropriation, or in situation when there is no such option (for example, when the Treasury has made the sale of mentioned property) - receiving monetary compensation.
